Workplace Investigations

Our work is personal.

Each investigation is unique. Also, most workplace investigations present circumstances in which feelings are hurt, livelihoods and liability are on the line, and details matter. A prompt, thorough, and neutral investigation by a qualified and experienced investigator can be the difference between reinstating harmony at work and considerable liability for the employer.

We adhere to established investigative practices and protocols within our industry to conduct timely, thorough, and impartial investigations for public and private entities. At the onset of our investigation, we collaborate with the client to understand the organization’s culture, policies and procedures, and to identify the scope of the investigation. We then prepare an investigative strategy based on the unique circumstances presented. We gather and evaluate relevant evidence, interview appropriate witnesses, and establish rapport with parties and witnesses.

The investigative strategy is reevaluated at each step of the process to maximize party cooperation and minimize potential publicity. At the end of the investigation, we provide clients with a report which is clear, reliable, and defensible.

Our standard for our own work is high. As a result, we consistently satisfy our client’s needs. We are trained and have extensive experience in conducting trauma-informed interviews as well as interpreter-assisted interviews.

Title IX Investigations

School is for learning.

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance." (Title IX, Education Amendments of 1972).

Title IX prohibits sex or gender discrimination in any educational program or activity receiving federal financial assistance. We investigate Title IX complaints of gender discrimination, including allegations of sexual harassment and sexual violence.

The U.S. Department of Education (DOE) issued new Title IX Regulations on August 14, 2020. We are well-versed in and heavily trained on the DOE regulations. We further customize our investigations according to campus policy.

There is no cookie-cutter set of facts in investigations. As such, we customize our approach in each investigation. At the onset of our investigation, we collaborate with the school’s Title IX office to understand the school’s policies and procedures, and to identify the scope of the investigation. We then prepare an investigative strategy based on the unique circumstances presented. We gather and evaluate relevant evidence, interview appropriate witnesses, and establish rapport with parties and witnesses.

It cannot be stressed enough, how heavily we rely on our trauma-informed interviewing skills in campus investigations. Violence, trauma, and/or being victimized affect an individual in immeasurable ways. The wrong approach in Title IX interviews drastically reduces the reliability and amount of information gatherable.

We provide training to human resources and internal leadership regarding their legal obligations when receiving complaints and conducting investigations. We also provide counsel CLE opportunities covering emerging ethical issues in workplace investigations.
